Terms of Service

1. About these terms
These terms cover your use of kirkwebdesign.com. Where we carry out paid work for you, the signed proposal, quote, or service agreement for that project governs first. These terms fill in anything that agreement does not address.
2. Using this website
You may browse this site and use its forms and calculators for their intended purpose. You agree not to attempt to disrupt the site, gain unauthorised access to any part of it, scrape it at a scale that degrades service, or use it to send unlawful or abusive material.
3. Quotes and estimates
Prices shown on this site are starting figures or published plan rates, not a binding offer for a particular project. Scope, inclusions, payment timing, and any third-party costs are confirmed in writing before work begins.
4. Client projects
Scope and timeline
Each project is defined by its written scope. Timelines assume content, feedback, and approvals arrive when scheduled. Delays in supplying material move the delivery date.
Your content
You are responsible for material you supply, including text, images, logos, and any credentials. By supplying it you confirm you have the right to use it. We are not liable for third-party claims arising from material you provide.
Revisions
The number of revision rounds included is set out in the project agreement. Work beyond that is quoted separately before it begins.
5. Payment
Payment terms are set out in the relevant quote or agreement. Managed plans include the minimum term stated in that agreement and bill on a recurring basis. Payments are processed by Stripe. Late or failed payment may pause work or suspend hosting and support after reasonable notice.
6. Ownership
For a one-time website project, ownership of the finished design, supplied content, and project-specific custom code transfers after final payment. For a managed website or growth partnership, transfer occurs after the minimum term and all amounts due have been paid. The signed agreement controls if it states different or more specific terms.
We retain ownership of underlying tools, frameworks, and reusable components developed independently of your project, and we keep the right to show the finished work as a portfolio piece unless you ask us in writing not to.
Everything on kirkwebdesign.com itself, including its design, copy, and code, remains our property.
7. Hosting, maintenance and third parties
Where a plan includes hosting or maintenance, we aim for continuous availability but do not guarantee uninterrupted service. Parts of the service depend on third parties such as hosting providers, domain registrars, and payment processors, and their outages are outside our control.
8. Cancellation
Cancellation terms follow the relevant agreement. For one-off builds, work completed up to the cancellation date is payable. For monthly plans, the notice period and any minimum term are set out in that plan.
9. Warranties and liability
We carry out work with reasonable skill and care. Beyond that, this website and its content are provided as they are, without further warranty. We do not warrant particular search rankings, traffic levels, or business results, since those depend on factors outside our control.
To the extent the law allows, our total liability arising from a project is limited to the fees you paid us for that project, and we are not liable for indirect or consequential loss such as lost profits or lost data.
10. Governing law
These terms are governed by the laws of the State of Indiana, and the courts of Indiana have jurisdiction over any dispute.
11. Changes
We may update these terms. The current version is always the one posted here, with the date shown at the top.
